A judge's ruling keeps a permanent injunction on Gemini in place, even though the CFTC joined the exchange in requesting it be withdrawn.

A federal judge has refused to let Gemini and the CFTC tear up the $5 million settlement the Winklevoss twins’ exchange agreed to in January 2025, even though the regulator joined Gemini in asking him to.
The case dates to 2022, when the CFTC accused Gemini of making false or misleading statements about a proposed Bitcoin futures product. In a ruling Thursday, U.S. District Judge Alvin Hellerstein said neither the CFTC’s shift in enforcement priorities nor misconduct allegations against its enforcement division justified reopening a deal Gemini signed about three weeks before trial.
The decision keeps in place a permanent injunction barring Gemini from making false statements to the agency, and the $5 million, already paid, stays with the government. It marks a rare occasion in which a court has held firm, even as a regulator pulls back from its own case.
